Straightforward Licensing
MDA Federal is committed to principal of allowing our NaturalVue 15-meter image mosaic products to be used by our customers in the most open and flexible way possible. To that end, MDA Federal has adopted the following “Down-to-Earth” licensing structure.
MDA Federal’s NaturalVue 15-meter imagery licenses are available in either an End-user or OEM Integrator type. End-user licenses allow use of the imagery for essentially any creative or technical purpose other than resale or distribution of the product. OEM licenses allow embedded use and distribution of the imagery in physical devices, software applications and web applications. Our licensing terms are simple and to the point… with the intent of allowing no-nonsense, minimally constrained use of the NaturalVue image mosaic products. The general terms of each license type follow below.
Summary of NaturalVue data rights:
The Licensee acknowledges that MDA Federal Inc. holds copyright of NaturalVue image mosaic data, herein referred to as the Licensed Product, and makes no transfer of this copyright to any third party. Use of the Licensed Product by anyone other than the Licensee shall constitute infringement of these rights.
Derived Products – any and all products derived from the NaturalVue image mosaic products that do not contain the NaturalVue pixel data (e.g. extracted vectors, multispectral classification products, etc.) are the property of the licensee and do not fall under this license agreement. All derived products that contain the NaturalVue pixel data (e.g. image maps, perspective views, prints, etc.), herein referred to as “derived-pixel products”, remain under the MDA Federal Copyright, with requirements as specified under each of the license types below.
Upon license fee payment for the use of data, MDA Federal Inc. grants to the Licensee a limited, perpetual, non-exclusive license to use the provided Licensed Product under the following license terms:
Single Site Multiple-workstation End-user License
- The Licensee may make copies and use the Licensed Product on any number of workstations at a single licensed physical location;
- The Licensed Product may be delivered via networked connection to workstations at the licensed site or may be copied to individual workstations at the licensed site;
- The Licensee, including contractors or consultants working for the Licensee at the licensed site, may use the Licensed Product in the production of any derivative product of any media type;
- The Licensee may distribute derived-pixel products created using the Licensed Product to any workstation at the licensed physical location; and
- The Licensee may distribute or publish derivative-pixel products created using the Licensed Product -- for viewing purposes only -- to third parties external to the licensed site, for commercial gain or not, as long as the derivative-pixel product does not contain a reusable form of the Licensed Product. This means that distributed derivative-pixel product data must be static, such as 3D renderings, animations or prints, where the Licensed Product data does not exist within the derivative-pixel product in its original form or any form substantially similar to its original form.
Company/Agency-wide End-user License
- The Licensee may make copies and use the Licensed Product on any number of workstations within a single company or government agency across multiple physical locations;
- The Licensed Product may be delivered via networked connection to workstations within the licensed company or government agency or may be copied to individual workstations at the licensed company or government agency;
- The Licensee, including contractors or consultants working for the Licensee, may use the Licensed Product in the production of any derivative product of any media type;
- The Licensee may distribute derivative-pixel products created using the Licensed Product to any workstation within the licensed company or government agency; and
- The Licensee may distribute or publish derivative-pixel products created using the Licensed Product -- for viewing purposes only -- to third parties external to the licensed company or government agency, for commercial gain or not, as long as the derivative-pixel product does not contain a reusable form of the Licensed Product. This means that distributed derivative-pixel product data must be static, such as 3D renderings, animations or prints, where the Licensed Product data does not exist within the derivative-pixel product in its original form or any form substantially similar to its original form.
OEM (Integrator/Unlimited) License
- The Licensee may make copies and use the Licensed Product on any number of workstations within a single company or government agency across multiple physical locations;
- The Licensee may embed protected copies of the Licensed Product, in part or in whole, into unlimited physical devices and/or software applications manufactured by the Licensee for external distribution to third parties, for commercial gain or not. The embedded form of the Licensed Product data must be protected by use of a Licensee-proprietary data format that prevents extraction or reconstruction of the Licensed Product, or data substantially similar to the Licensed Product, by third parties into any reusable format that could be used on any other system other than that created and provided by the Licensee. The Licensee must display the MDA Federal Inc. copyright notice, "NaturalVue Copyright MDA Federal Inc." somewhere on the package or documentation accompanying the distribution of all embedded copies of the Licensed Product; and
- The Licensee may embed the Licensed Product into Internet web services for external distribution to third parties, for commercial gain or not. The Licensed Product data must be protected to prevent downloading of the Licensed Product, or data substantially similar to the Licensed Product, by third parties into any reusable format. The Licensee must display the MDA Federal Inc. copyright notice, "NaturalVue Copyright MDA Federal Inc." with the web display of any part of the Licensed Product.
